ambient sound level

The reading of a sound level meter taken at a measuring point in the absence of any alleged disturbing noise at the end of a total period of at least 10 minutes after such meter was put into operation.

noise level
The reading of a sound level meter taken at a measuring point in the presence of any alleged disturbing noise at the end of a total period of at least 10 minutes after such meter was put into operation and, if the alleged disturbing noise has a discernable pitch, for example, a whistle, buzz, drone and music, to which 5 dBA has been added

noise nuisance
Any sound, which disturbs or impairs or may disturb or impair the convenience or peace of any person

 
     
   
 
Penalties and Seizures
 
 

Any person who is found guilty of an offense will be liable for a conviction to a fine not exceeding R20 000 or to the imprisonment for a period not exceeding two years, or to both such a fine and such imprisonment.

If the owner or person in charge of power tools, musical instruments and equipment fails to comply with an instruction, the tools, musical instruments or equipment can be confiscated or impounded.

 
 
The Law on Noise Nuisance / Pollution
 


No person shall –

operate or play, or allow to be operated or played,
radio, television set, drums, musical instrument, sound amplifier, loudspeaker system or similar device
producing, reproducing or amplifying sound
so as to cause a noise nuisance

 
Powers of a Local Authority

Authorities intending to apply any of the regulations governing Noise Pollution may enter a premises without prior notice - to conduct any appropriate examination, enquiry or inspection as it may deem expedient; and take any step that may be deemed necessary.

If a noise emanating from a building is a disturbing noise or noise nuisance, authorities will instruct in writing the person causing such noise or is responsible therefore to discontinue or cause to be discontinued such noise within the period stipulated in the instruction

“Local authority“ means a transitional local council and a transitional rural council established in terms of the Local Government Transition Act, 1993 (Act 209 of 1993)
